These Terms of Use (hereinafter — the "Terms") govern the relationship between the individual entrepreneur (sole proprietor) Oleksandr Mykhailovych Papish (hereinafter — the "Owner", the "Provider") and any individual or legal entity that visits and/or uses the website papish.online (hereinafter — the "Website", the "Platform") (hereinafter — the "User").

By using the Website in any form — browsing pages, registering, paying for services, leaving reviews and comments, etc. — the User confirms that they have read these Terms, understand their content, and unconditionally agree to them in full. If the User does not agree with any provision of these Terms, they must stop using the Website.

These Terms are drawn up in accordance with the legislation of Ukraine, in particular the Civil Code of Ukraine, the Law of Ukraine "On Copyright and Related Rights," the Law of Ukraine "On Personal Data Protection," the Law of Ukraine "On Electronic Commerce," the Law of Ukraine "On Consumer Rights Protection," and the Law of Ukraine "On the Protection of Information in Information and Telecommunication Systems."

1. General Provisions

1.1. The Owner and administrator of the Website is the individual entrepreneur (sole proprietor) Oleksandr Mykhailovych Papish (details are provided in Section 10 of these Terms).

1.2. These Terms apply to all sections and pages of the Website and its services, including the blog, the courses and webinars section, feedback forms, and the User's personal account.

1.3. The purchase of educational services (courses, webinars) offered on the Website is governed by a separate document — the Public Offer Agreement, which forms an integral part of the relationship between the Owner and the User when ordering paid services. In the event of any conflict between these Terms and the Public Offer Agreement with respect to paid services, the provisions of the Public Offer Agreement shall prevail.

1.4. The Owner has the right to unilaterally amend these Terms. The updated version takes effect from the moment it is published on the Website. Continued use of the Website after such changes have been made constitutes the User's consent to those changes.

2. Terms and Definitions

2.1. Website — the web resource located at papish.online, including all its subdomains, mobile, and other versions.

2.2. Content — any text, graphic, audio, and video materials, training programs, images, logos, trademarks, databases, and other objects placed on the Website.

2.3. User — any individual or legal entity that visits the Website and/or uses its functionality.

2.4. Personal Account — a section of the Website, access to which the User receives after registration, intended for managing purchased services.

3. Intellectual Property Rights

3.1. All intellectual property objects placed on the Website, including texts, design, logos, images, video and audio materials, training programs, databases, and program code, are the property of the Owner or are used by it on a lawful basis (under a license from the rights holders) and are protected by the Law of Ukraine "On Copyright and Related Rights" and the norms of international law.

3.2. The User is permitted to view the Website's Content solely for personal, non-commercial use. It is prohibited to:

• copy, reproduce, distribute, publicly display, or otherwise use the Website's Content for commercial purposes without the Owner's written permission;

• remove, conceal, or alter copyright notices, trademarks, or other proprietary markings on the Content;

• create derivative works based on the Website's Content without the Owner's consent;

3.3. Infringement of the Owner's intellectual property rights entails civil, administrative, or criminal liability in accordance with the legislation of Ukraine.

4.2. The User is prohibited from:

• posting information on the Website (in forms, comments, reviews) that violates the legislation of Ukraine, the rights of third parties, contains calls for violence or discrimination, is false, or infringes the copyright of third parties;

• using the Website to distribute malicious software, spam, or viruses;

• transferring access to their personal account to third parties;

• using the Website in a manner inconsistent with its intended purpose, or for purposes other than obtaining information about the Owner's educational services or purchasing them.

4.3. The Owner has the right to restrict or terminate a User's access to the Website in the event of a violation of these Terms, without prior notice and without providing reasons.

5.1. The processing of Users' personal data is carried out by the Owner in accordance with the Law of Ukraine "On Personal Data Protection" and the Privacy Policy, which forms an integral part of these Terms.

5.2. By using the Website, the User grants the Owner consent to process their personal data (name, email address, phone number, and other data provided through forms on the Website) for the purposes of ensuring the operation of the Website, communicating with the User, providing educational services, and complying with legal requirements.

7.2. The Owner bears no liability for any direct or indirect damages arising from:

• temporary unavailability of the Website due to maintenance work, failures on the part of the hosting provider, or other circumstances beyond the Owner's control;

• actions of third parties, including unauthorized access to the User's data resulting from the User's failure to comply with security rules (such as safeguarding their password);

The relationship between the Owner and a consumer-User with respect to the purchase of paid educational services is governed by the Law of Ukraine "On Consumer Rights Protection" and the Law of Ukraine "On Electronic Commerce," to the extent not inconsistent with the terms of the Public Offer Agreement.

8.2. The User has the right to contact the Owner with questions, claims, or complaints regarding the quality of services using the contact details specified in Section 10 of these Terms.

9. Applicable Law and Dispute Resolution

9.1. These Terms are governed by and construed in accordance with the legislation of Ukraine.

9.2. All disputes arising in connection with the use of the Website shall be resolved through negotiations, and if no agreement is reached, in court in accordance with the legislation of Ukraine.
